1. Copyright Protection
Xshiver respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to clear notices of alleged copyright infringement.
2. DMCA Takedown Procedure
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our DMCA agent with a written notice containing the following information:
- Physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed, or if multiple works, a representative list
- Identification of the infringing material and information sufficient to locate it on our platform (including specific URLs)
- Your contact information including name, address, telephone number, and email address
- A statement of good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement of accuracy under penalty of perjury that the information provided is accurate and you are authorized to act on behalf of the copyright owner
3. Counter-Notification Procedure
If you believe your content was removed in error or due to misidentification, you may submit a counter-notification to our DMCA agent containing:
- Your physical or electronic signature
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
- Your name, address, phone number, and a statement consenting to jurisdiction of the federal court in your district
Upon receipt of a valid counter-notification, we may restore the content within 10-14 business days unless the copyright owner files a court action.
4. Repeat Infringer Policy
We maintain a policy of terminating accounts of users who are repeat copyright infringers. Users who repeatedly infringe copyrights will have their accounts permanently suspended.
